Terms & Conditions

Important Customer Information


This website, www.divealotscuba.co.uk , is operated by Dive a lot Scuba. These terms will apply to all your purchases of items from the retail section of our websites, whether you are ordering online or by telephone. Please read this document carefully and print it off or download it before placing your order.

We may change these terms from time to time. Please check them before you make a new purchase.


PAYMENT

You can pay for your order by Visa, Mastercard, direct into our Bank Account or via our Tele-sales Department on Sleaford (01529) 968060. We will take all reasonable care to keep your order details and payment secure, but, unless we are negligent, we will not be liable for any losses if an unauthorised third party obtains access to your information.


If billing and delivery addresses are not the same, we may require a utility bill for confirmation. Payments will not be accepted for Credit or Debit Cards if not delivered to the Card Holder's address.


All prices quoted on our website include VAT.


YOUR AGREEMENT WITH US

We will confirm acceptance (or otherwise) of your order as soon as possible, either by email (if your order is placed online) or by telephone (if your order is placed over the telephone). A binding agreement arises once we accept your order and we will then charge your credit/debit card on acceptance of your order.


DELIVERY

Delivery is to mainland UK only. We do not make overseas deliveries. We will advise you regarding shipping. All items are to be signed for on delivery.


AVAILABILITY

All items are subject to availability. We can only guarantee availability whilst stocks last. If the goods ordered are unavailable, we will contact you with suggestions of goods of equivalent quality and price. We will endeavour to deliver goods within the times stated but goods are subject to availability and delay in delivery of goods is sometimes out of our control. Any dates we specify for the delivery of goods are approximate and we shall not be liable for any losses, costs, damages, charges or expenses caused by any delay for delivery of the goods.


RIGHT OF CANCELLATION

Under the Consumer Protection (Distance Selling) Regulations 2000, you have an unconditional right to cancel an order. You can exercise the right to cancel an order by informing us in writing within the following time limits ('24 Hours of the order) by e-mail using the 'Contact Us' screen or sales@divealotscuba.co.uk.


CANCELLATION PERIOD

From the date the order is accepted by us until 7 working days after the goods are delivered. (see below)


RETURN OF CANCELLED GOODS

Where goods have already been dispatched, customers exercising their right to cancel an order must ensure that reasonable care is taken of the goods and that they are returned to us at the customer's expense and risk in an 'As New' condition, without any damage caused by excessive or unreasonable use. To be returned in their original packaging to prevent any damage in transit. Any unreasonable damage to the products may result in you not receiving a full refund. The returned goods must include all instructions and all cables and accessories. The return must also include any premium offers or free gifts offered with the product.


You should return the goods as soon as possible following cancellation. You will be liable for charges for the postage or collection of the goods by us. Furthermore if you do not return the goods within a reasonable time., normally within 7 working days of receipt of the goods, you are deemed to have accepted the goods and therefore will be recharged as per the order on the website. Alternatively We can arrange the return of the goods if requested at your expense.


REFUND OF CANCELLED GOODS

We will refund the purchase price of the goods but not the original delivery charge within 30 days of your cancellation notice once the goods have been returned at your expense and checked as new and complete,. The speedy return of goods can prevent delays in receiving your refund.


EXCEPTIONS

Please be aware there are a few exceptions where an order cannot be cancelled, namely-when a product has been made to order or personalised in any way, when the seal has been broken (opened) on software, recorded media and consumables.

Dive Computers can not be returned if they have turned on or registered with the manufacturer. (because these would be classed as second hand and would not be able to be resold)

Special order items can not be returned and will be  needed to be paid for upfront, please note these items make take time to arrive, to the store.

Special order items which are personalised or made to measure cannot be returned,

Masks and Snorkels also can not be returned, due to hygiene.


DAMAGED GOODS

If you receive goods in a damaged condition, please make a note of this on the despatch note. You will need to notify us of this by phone, email or letter in any case within 24 Hours from receipt of goods.


Note: Except in respect of faulty or defective goods, nothing in these terms and conditions shall give to the customer rights of cancellation in regard to goods made to the customer's specifications or clearly personalised.


We will reimburse any amounts you have paid to us within 30 days of cancellation, having deducted any return costs ( if applicable).


This guarantee is in addition to any warranties or conditions implied by law and nothing in these terms affects your statutory rights.


DELAY OR FAILURE TO PERFORM

We shall not be liable to you if we are prevented or delayed in performing  any of obligations to you if this is due to any cause beyond our reasonable control eg :an act of God, explosion, flood, fire or accident war or civil disturbance, strike, industrial action or stoppages of work, any form of government intervention, a third party act or omission failure by you to give us a correct email or delivery address or notify us of any change of address.

If this happens we shall inform you as soon as is reasonably practicable and if these circumstances continue for 30 days either you or we will be free to cancel the contract. If so, we will give you a full refund of any payment we have received from you within 30 days of cancellation.

However, we cannot guarantee that your monitor's display of any colour will accurately reflect the colour of the actual product. Images are for display only and may not be accurate.


The products sold on this website have been designed to comply with the health and safety laws of the UK and we cannot warrant or represent that they comply with any health safety or other legal requirement outside the UK.


GOVERNING LAW

All contracts formed between us for the purchase of items from this website shall be governed by English law and any dispute shall be subject to the jurisdiction of the English Courts.


If any provisions of these terms and conditions shall be unlawful, void or for any reason unenforceable then that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.
